Terms and Conditions
The following lists the terms and conditions which
govern the banner creation services offered by Fishresource.com.
Acceptable Sites
In general, Fishresource.com will accept a banner
creation request for most businesses and sites. Your
site does not necessarily have to be a fishing industry
related site. Most commercial, non-commercial, or personal
pages are acceptable.
However, banner creation requests from the following
types of sites will not be accepted:
- No pornographic or adult oriented materials or
links to such materials.
- No pirated software or links to such materials.
- No hackers programs, archives or links to such
materials.
- No warez sites or links to such materials.
- No content that may be considered prejudicial or
abrasive to a individuals Race, Creed or Colour.
- No content promoting or advocating violence against
individuals, groups or Organizations or links to
such content.
- No content promoting or advocating illegal actions
or practices, or links to such content.
- No businesses of any illegal nature.
- No businesses that sell email lists or bulk email
software.
- No site whose sole or majority content is simply
links to other sites.
In all cases Fishresource.com reserves the right to
decline a banner creation request for any business
or any web site for any reason whatsoever. Further,
acceptance of a request for banner creation from a
business or web site does not guarantee future requests
for a banner creation will be accepted. If content
of any site previously accepted for our banner creation
service change in any form such that it no longer meets
the terms of this policy (as deemed by Fishresource.com
who is the sole arbiter) we reserve the right to deny
or cancel such request(s) without prior notice. Notification
of cancellation is described in the sections below.
The Service Fishresource.com Provides
Fishresource.com will create a banner for your business
and/or web site. We typically create banners that adhere
to generally accepted internet standards of size (length
and height as measured in pixels). If you wish to have
a custom banner created, contact us and we will discuss
your request.
We will make a "best effort" to create the
smallest file size (as measured in Kilobytes). However
we do not promise or guarantee a specific file size
for any given banner request. Typically the more graphics,
fonts, photos, backgrounds, colours etc. you request,
the larger the resulting file size will be.
Cost of the Service
The cost of banner creation depends on many factors
including but not limited to the size and number of
banners requested, the complexity of the layout and
the use of graphics, fonts, colours, etc. Each request
for banner creation will be reviewed individually and
a price quoted to you before work begins. Unless otherwise
specified all quotes for banners are good for 30 calendar
days from the day of the quote being sent. You must
accept and agree to the quote before work begins. Additionally,
Fishresource.com reserves the right to modify the cost
previously quoted for a request depending on any changes
or modifications you may make to the requested banner(s).
What the Client will Provide
As the requestor of a banner you the client should
to provide Fishresource.com with directions as to how
you wish your banner to look. This includes but is
not limited to size (as described above), background
colours or graphics, font size style and/or colour,
the name of your business and/or web site, the wording
to use on your banner, any slogans or branding phrases,
etc.
In all cases if you do not specify a particular requirement
of the banner Fishresource.com will use our own judgment
to complete your request. You agree to accept any decisions
made by Fishresource.com. Further, you agree to accept
any delays and/or additional costs that may arise by
you not providing the required information or not providing
the information in a timely manner.
Additionally, Fishresource.com will accept a graphic,
logo or scanned photograph to be included on your banner.
In all cases Fishresource.com reserves the right to
decline the use of a graphic, logo or scanned photograph
for any reason. The graphics you provide must comply
with copyright laws. Also, in order to fit the graphic
into the size banner(s) you are requesting we may need
to modify the image including but not limited to resizing,
cropping, rotating or changing the orientation. You
agree to allow Fishresource.com to make these modifications
at our discretion.
Verification of the Information You Provided
In all cases Fishresource.com does not confirm or verify the information you provide to be included in your banner(s). This includes but is not limited to claims and/or representations about your products and/or services, guarantees, status of your business or web site, or performance of your products and/or services. You are solely responsible for any claims and/or statements you made in your banners.
How to Request a Banner
Simply email us at sales@fishresource.com with
a brief description of what you are looking for and
whether it is for advertising on Fishresource.com,
or for another web site.
Requests are reviewed for suitability as per these
terms and conditions, and we will first review your
site to ensure it meets our suitability standards as
defined above. We will make a "best effort" to
review your site within 48 hours of receiving your
request and upon review provide you with notification
if we accept or decline you request. If we accept,
we will contact you to discuss your requirements.
Once we have received and discussed your requirements,
we will create a sample banner. We will make a "best
effort" to create the sample banner(s) within
5 business days of confirming your instructions and
requirements. The sample banner(s) will be made available
for your review either by sending you the sample banner(s)
via email or placed for your viewing on a page at our
site (our discretion which method to use). In all cases
we reserve the right to label the sample banner(s)
as "sample" until you have accepted the work
and it has been paid for in full.
If have any comments and/or change requests for the
banner(s) we created you will send them to us within
5 business days of being notified the sample(s) is
ready for your review. We will make a "best effort" to
comply with your comments and/or change requests with
in 5 business days of receiving them. We will again
provide a modified sample(s) of the banner(s) by the
methods described above.
Acceptance and Payment
Once you have accepted the banner(s) we have created,
your payment in full is to be sent promptly. We accept
several forms of payment.
When we have received your payment in full we will
make your banner(s) available to you either by email
or for download from a page on our site (your choice
which method). The final version of your banner will
not contain the "sample" labelling or watermark.
Additional Changes after Acceptance and Payment
If you request additional changes or modifications
to your banner(s) after you have accepted and paid
for the banner(s) Fishresource.com reserves the right
to charge additionally for these changes or modifications.
Safeguarding your Banner(s)
Protecting your banner(s) from accidental loss, corruption,
etc. is your own responsibility! Fishresource.com is
not required to keep copies of your banner(s) for you,
and will not be responsible for any losses or business
interruption incurred. In the event of accidental loss,
corruption, etc. of your banner(s) Fishresource.com
reserves the right to charge additionally to recreate
any lost banners.
Waiver of Liability
This banner creation service is provided "as
is" by Fishresource.com and without any promises,
warranties and/or guarantees in regard to the service
or products created. This includes but is not limited
to increasing hits visits or traffic on your site,
increased sales, improved name recognition or product/service "branding",
higher search engine rankings, readiness and/or reliability
of the technology used to create the banner(s), ability
to be viewed by visitors to your web site, acceptance
into banner ad or exchange programs, and banner loading
speeds.
By submitting a request for a banner creation you
agree to "hold harmless" and indemnify in
perpetuity Fishresource.com, it's owners, employees
and official representatives from any and all claims
associated with the banner(s), including but not limited
to fraud, misrepresentation, illegal activity, copyright
infringement, intellectual property rights, or any
other claims or damages.
Further, by submitting a request for banner creation
you certify that you have the legal authority and capacity
to request a banner be created for the specified business
and/or web site. Additionally, you certify that you
have the legal authority and capacity to submit for
use in your banner any graphics (including but not
limited to clip art, backgrounds and photographs) without
copyright or intellectual property infringements. You
agree to "hold harmless" and indemnify in
perpetuity Fishresource.com, it's owners, employees
and official representatives from any claims resulting
from such claims for graphics used in creating your
banner.
If we accept the banner creation request you grant
Fishresource.com permission to use your business or
web site name without cost or other consideration to
market and promote the products and services of Fishresource.com.
Further, we reserve the right to show your banner(s)
as examples of our work to other perspective clients.
No part of this agreement and terms and conditions
shall be considered a contract or exclusive agreement.
These terms are subject to change without notice and
do not replace, modify or supercede anything stated
on our About Us page. By
submitting a request for banner creation you agree
to be bound by these terms in total.
